By creating an account and using KotStock ("the Service"), you acknowledge and agree to the following terms. If you do not agree, do not create an account or use the Service.
KotStock is an AI-powered trade planning assistant. It generates trade plan suggestions based on artificial intelligence analysis. The Service is provided on a "best efforts" basis. KotStock is not a registered investment adviser, broker-dealer, or financial planner. Nothing provided by the Service constitutes financial advice, investment advice, trading advice, or any other form of professional advice.
The AI-generated trade plans, analysis, and suggestions may contain errors, inaccuracies, or omissions. AI models can and do make mistakes. Market data may be delayed, incomplete, or incorrect. You acknowledge that no trade plan or analysis is guaranteed to be accurate, complete, or profitable.
Trading stocks, options, and other financial instruments involves substantial risk of loss and is not suitable for every investor. You may lose some or all of your invested capital. By using the Service, you acknowledge that you assume full responsibility for all trading decisions and any resulting financial outcomes, including losses.
To the maximum extent permitted by applicable law, KotStock and its operators, developers, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, resulting from: (a) your use of or inability to use the Service; (b) any trade plan, suggestion, or analysis provided by the Service; (c) errors, mistakes, or inaccuracies in AI-generated content; (d) unauthorized access to or alteration of your data; (e) any other matter relating to the Service.
You should consult a qualified financial professional before making any investment decisions. The Service does not take into account your individual financial situation, risk tolerance, or investment objectives.
When you choose to execute trades through Interactive Brokers (IBKR) or any other broker via the Service, you acknowledge that order execution is performed on a best-efforts basis. Technical failures, network issues, API errors, or incorrect parameters may result in orders not being placed, being placed incorrectly, or being partially filled. KotStock is not responsible for any trading losses resulting from order execution issues.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, secure, or error-free operation of the Service.
By using the Service, you acknowledge and agree that we may collect, store, and process user data, including but not limited to: account information (email address, authentication tokens), usage data (trade plans generated, features used, session activity), technical data (IP address, browser type, operating system, agent version), and trading-related data (tickers analyzed, order parameters). This data is used to operate, maintain, and improve the Service. We will not sell your personal data to third parties. We may use aggregated, anonymized data for analytics and service improvement purposes.
We reserve the right to modify these Terms of Use at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.
These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
You agree not to copy, reproduce, reverse-engineer, redistribute, or create derivative works based on the Service's proprietary algorithms, AI-generated analysis methods, trade planning logic, prompt engineering, system architecture, or any other intellectual property of KotStock. You may not scrape, systematically download, or aggregate outputs from the Service for the purpose of building a competing product or service. Sharing your account credentials with third parties is prohibited. Violation of these provisions may result in immediate termination of your account and legal action.
By signing and creating an account, you confirm that you have read, understood, and agree to be bound by these Terms of Use, including the confidentiality and intellectual property provisions.
